Rules and Etiquette for NHBA E-mail Discussion Groups

Rules
E-mail Etiquette
Disclaimer

E-mail discussion groups have been established for each Section and other groups, such as the New Lawyers.

By joining and using NHBA e-mail lists, you agree to abide by the following common-sense rules.  You also agree to reserve list discussions for topics best suited to the medium, which is not a private one. List messages are for the use of NHBA members only and may not be distributed to non-members without the permission of the NH Bar Association.

These lists are generally not moderated, and your messages will not be screened before you send them.  Members of the Bar executive staff and the Section Coordinator also are members of the lists, and do monitor messages. However, we encourage any member that sees something inappropriate to contact the Section Coordinator or Member Services Coordinator as soon as possible. The Bar may suspend or remove a subscriber on a list for inappropriate postings.

Rules for E-mail Discussion Groups
The Bar reserves the right to suspend discussion groups if no activity occurs within six months. The Bar reserves the right to suspend or terminate membership on all lists for members who violate the following rules.
  1. Do not use the Listserve in anyway that could be alleged to violate anti-trust laws. (See the Jan. 2007 letter from NHBA Past President Richard NcNamara)

  2. Selling or marketing on NHBA e-mail discussion lists is not allowed.

  3. Discussions on the lists are meant to stimulate conversation, not to create contention.  Do not challenge or attack others.  Let others have their say, just as you may.

All defamatory, abusive, profane, threatening, offensive, or illegal messages are strictly prohibited.  Do not post anything in a message that you would not want the world to see or that you would not want anyone to know came from you.

  4. Do not post commercial messages.  Advertising of non-NHBA events on the lists is not permitted. Contact the Section Coordinator for information on the NHBA's advertising policy and fee schedule (this includes all classified ads and non-NHBA events).

  5. We discourage messages sent to all members of the list that disparage products or individuals. Information posted on the lists is available for all to see, and comments are subject to libel, slander, and antitrust laws.

  6. Do not post any information or other material protected by copyright without the permission of the copyright owner.

  7. Messages should not be posted if they encourage or facilitate members to arrive at any agreement that either expressly or impliedly leads to price fixing, a boycott of another’s business, or other conduct intended to illegally restrict free trade.  Messages that encourage or facilitate an agreement about the following subjects are inappropriate: fees, prices, discounts, or terms or conditions of sale; salaries; profits, profit margins, or cost data; market shares, sales territories, or markets; allocation of customers or territories; or selection, rejection, or termination of customers or supplies; or potential violation of current antitrust laws.
  1. No attachments. Due to the prevalence of email viruses in attachments (and the corresponding development of anti-virus, anti-spam software) and other complications, do NOT send attachments with your emails to the entire list. You may send attachments to individual email addresses, or, for section members, send the attachment to the Section Coordinator who will then make the attachment available on the Section's Web page.

    Limitations on discussion group memberships:
    • Sections: section members and subscribers only.
    • The New Lawyers list: available only to members admitted to NH Bar within last 5 years and New Lawyer's committee members.

Please remember that e-mail is not private, even when you think you know who all of the subscribers are. Messages can be forwarded easily, or shared with others. Be circumspect in your comments.

E-mail Etiquette
  • Signature Tag. Include a signature tag on all messages.  Include your name, affiliation, location, and e-mail address.  Please delete attached company business cards (such as "vCards") from e-mail.
  • Subject Line. State concisely and clearly the specific topic in the subject line.  This allows members to respond more appropriately to your posting and makes it easier for members to scan or review messages by subject.
  • Headers. Include only the relevant portions of the original message in your reply, delete any header information, and put your response before the original posting.
  • Think Ahead. Only send a message to the entire list when it contains information that everyone can benefit from.
  • Private Messages. Send messages such as “thanks for the information” or “ me, too” to individuals- not to the entire list.  Do this by using your e-mail application’s forwarding option and typing in or copying and pasting in the e-mail address of the individual to whom you want to respond.  Also, when posting a message, ask for private (or off-list) responses when the information you've requested is not appropriate for or useful to the entire list.
  • Long Messages. Alert other list subscribers of lengthy messages either in the subject line or at the beginning of the message body with a line that says “Long Message.” .
E-mail Discussion Group Disclaimer

Please note carefully all items listed in this disclaimer, particularly regarding the copyright ownership of information posted to the list.

The lists are provided as a service of the New Hampshire Bar Association. The NHBA accepts no responsibility for the opinions and information posted on the lists by others.  The NHBA disclaims all warranties with regard to information posted on the lists, whether posted by the NHBA or any third party; this disclaimer includes all implied warranties of merchantability and fitness.  In no event shall the NHBA be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from loss of use, data, or profits, arising out of or in connection with the use or performance of any information posted on the lists.

Do not post any information or other material protected by copyright without the permission of the copyright owner.  By posting material, the posting party warrants and represents that he or she owns the copyright with respect to such material or has received permission from the copyright owner.  In addition, the posting party grants the NHBA and users of the lists the nonexclusive right and license to display, copy, publish, distribute, transmit, print, and use such information.
